Chapter 17:  Employment

The legal relationship between the employee and the employer is governed by the contract of employment, as well as Federal and State legislation specific to employment issues. In many cases, the contract of employment will also be affected by either Federal or State industrial awards or industrial agreements, or by individual workplace agreements.

This chapter describes the law of employment and the rights and remedies which are available both at common law and under the industrial relations system - with particular reference to termination of employment.

Note that at the time of writing, the Federal government has proposed, through not yet introduced, significant changes to industrial relations laws in Australia. These are outlined in brief at the end of the chapter.

Injuries in the workplace are described in Chapter 26: INJURIES and discrimination and sexual harassment in the workplace is discussed in Chapter 15: DISCRIMINATION.
