Chapter 15: Disability and the Law

People with disabilities, including people with intellectual and decision-making disabilities, are a part of the community and have the same rights as other citizens, except in certain limited circumstances. Their ability to exercise their rights may be limited or enhanced to the extent that communities and services take account of their disabilities and focus on being truly accessible. Legal institutions have traditionally been highly formalised, requiring high levels of communication and the ability to understand complex rules. This chapter provides an overview of the Western Australian context relating to people with disabilities and the law. It seeks to provide information about disability and the particular areas of the law where special arrangements have been made to protect the rights of people with disabilities and to make legal institutions and agencies, and the community, accessible to all people, including those with disabilities.
